Terms of Service

1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of Product Quiz (the “App”), a Shopify application operated by the App developer (“we,” “us,” or “our”). By installing or using the App, you (“you,” “Merchant,” or “your”) agree to be bound by these Terms. If you do not agree, do not install or use the App.

These Terms apply to all merchants who install, access, or use the App. If you are using the App on behalf of a business or organization, you represent and warrant that you have authority to bind that entity to these Terms.

Your use of the App is also subject to Shopify’s Partner Program Agreement and Shopify’s Terms of Service, which govern the Shopify platform through which the App is distributed. In the event of a conflict between these Terms and Shopify’s terms with respect to the Shopify platform itself, Shopify’s terms take precedence.

2. Description of Service

Product Quiz is a Shopify app that lets merchants build product-recommendation quizzes shown on their storefront. Merchants create quizzes in the App’s admin interface — defining questions, answer options, and the mapping of answers to products or collections in their catalog. The quiz is then embedded on the merchant’s Shopify storefront via a Shopify App Proxy; shoppers answer the questions and receive personalized product recommendations drawn from the merchant’s catalog.

The App provides merchants with:

• A quiz builder for creating and editing quizzes within the Shopify Admin interface.
• A storefront quiz widget (served via Shopify’s App Proxy) that shoppers interact with on the merchant’s online store.
• Aggregate analytics showing quiz views, completion rates, and add-to-cart events per recommended product. All analytics data is anonymous — no shopper personal data is collected (see our Privacy Policy).
• On paid plans, additional quiz customization options and increased quiz capacity (see Section 3).

The App is a tool to help merchants engage shoppers through interactive content and personalized recommendations. It is not a guarantee of sales conversions, revenue outcomes, or specific shopper engagement levels. The recommendation logic is based on the answer-to-product mappings that you configure; the quality and relevance of recommendations depends on your configuration choices.

3. Service Plans and Pricing

The App is offered on two plans:

3.1 Free Plan

The Free plan is available at no charge and is sufficient for merchants getting started with product quizzes. It includes access to the quiz builder and storefront widget for a limited number of quizzes, basic aggregate analytics, and standard support.

3.2 Pro Plan

The Pro plan is available at $9.99 USD per month, billed by Shopify on a recurring monthly basis via the Shopify Billing API. It includes everything in the Free plan, plus enhanced quiz capacity (more quizzes and questions per quiz), additional customization options for the storefront widget, expanded analytics, and priority support.

A 14-day free trial is offered on the Pro plan. During the trial period you have full access to all Pro features. At the end of the trial period, Shopify will begin monthly billing unless you downgrade to the Free plan or uninstall the App before the trial ends.

We reserve the right to change the features included in each plan. For material changes to what is included in a paid plan, we will provide reasonable notice.

4. Billing, Charges, and Shopify Billing API

All charges for the Pro plan are processed by Shopify, Inc. through the Shopify Billing API. By subscribing to the Pro plan, you authorize Shopify to charge your Shopify account the applicable fees on a monthly recurring basis.

We do not collect, store, or process your payment card information directly. All payment processing is handled by Shopify. For questions about your billing statement or charges, refer to Shopify’s billing support.

We reserve the right to change the pricing of the Pro plan. We will provide at least 30 days’ notice of any price change via the App interface or by email to your store’s contact address. Continued use of the Pro plan after the effective date of a price change constitutes your acceptance of the new price.

Refunds are handled in accordance with Shopify’s app refund policies. In general, charges are non-refundable except as required by applicable law or as provided by Shopify’s policies.

All charges are billed in USD. Currency conversion costs and applicable taxes are handled by Shopify in accordance with its platform terms.

5. Free Trial Terms

The Pro plan includes a 14-day free trial. The trial begins on the date you activate the Pro plan subscription in your Shopify Admin.

If you do not cancel or downgrade before the end of the trial period, Shopify will begin charging the Pro plan monthly fee. To avoid being charged, you must downgrade to the Free plan or uninstall the App before the 14-day trial period expires.

If you uninstall the App during the trial period, your subscription will be cancelled. If you reinstall the App after a previous trial has been used, a new free trial may not be available; Shopify’s billing rules govern trial eligibility.

We reserve the right to modify or discontinue the free trial offer at any time for new subscribers.

6. Your Shopify Account and Access

You must have a valid Shopify store and be logged into your Shopify Admin in order to install and manage the App. The storefront quiz widget is accessible to all shoppers on your storefront once you publish a quiz.

You are responsible for maintaining the security of your Shopify account. We are not responsible for any loss or damage arising from unauthorized access to your Shopify account.

The App is granted specific Admin API scopes when you install it — read_products, read_product_listings, and write_app_proxy (see our Privacy Policy for details). You can revoke these permissions at any time by uninstalling the App. Upon uninstall, the App will no longer have access to your store and your data will be deleted per the terms in our Privacy Policy.

7. Your Quiz Content and Responsibilities

You are solely responsible for the quizzes you create using the App, including the questions, answer options, product mappings, and any custom text displayed to shoppers. By creating a quiz, you represent and warrant that:

• You own or have the right to use all content you include in your quizzes (text, branding, product information).
• Your quiz content does not violate any applicable law, regulation, Shopify’s terms of service, or these Terms.
• Your quiz content does not infringe any third-party intellectual property, privacy, or publicity right.
• You will not use the App to create quizzes that are deceptive, misleading, discriminatory, or harmful to shoppers.
• The product recommendations your quizzes surface to shoppers are accurate representations of available products in your store.

You retain all ownership of your quiz content. By creating quizzes in the App, you grant us a limited, non-exclusive license to store, serve, and display your quiz content solely for the purpose of operating the App on your behalf — i.e., to show the quiz to your shoppers and to display your quiz in the admin interface. We do not use your quiz content for any other purpose.

8. Termination

By you: You may terminate your use of the App at any time by uninstalling it from your Shopify Admin. Upon uninstall, the App will no longer have access to your store, and your quiz widget will stop appearing on your storefront. Your stored data will be retained for up to 30 days (to support reinstall) and then permanently deleted, or immediately upon receipt of a Shopify shop/redact webhook. Any active Pro plan subscription will be cancelled via the Shopify Billing API.

By us: We reserve the right to suspend or terminate your access to the App if you violate these Terms, if your use disrupts our service to other merchants, if we are required to do so by Shopify or applicable law, or if we discontinue the App. In the event of App discontinuation, we will provide at least 30 days’ notice where reasonably possible.

Upon termination, all provisions of these Terms that by their nature should survive — including limitations of liability, disclaimers, and indemnification obligations — shall survive.

9. Acceptable Use

You agree not to use the App to:

• Violate any applicable law, regulation, or Shopify’s terms of service.
• Create quizzes designed to deceive, manipulate, or harm shoppers, including dark-pattern quizzes designed to extract personal information under false pretenses.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App or its recommendation logic.
• Automate requests to the App’s API endpoints in a manner that places unreasonable load on our servers or on Shopify’s infrastructure (e.g., scripting hundreds of quiz-start events per minute for testing or data harvesting).
• Resell, sublicense, or white-label the App or its outputs without our written permission.
• Use the App to access product or catalog data for any store other than the one for which you have installed and authorized the App.
• Attempt to circumvent, disable, or interfere with security-related features of the App, including HMAC webhook verification, App Proxy signature verification, or session authentication.

Violation of these acceptable-use terms may result in immediate termination of your access to the App.

10. Intellectual Property

The App, including its source code, design, quiz-engine logic, trademarks, and content (excluding your quiz content and your store data), is and remains the exclusive property of the App developer. Nothing in these Terms transfers any ownership or intellectual property rights to you.

You retain all ownership of your quiz content (your questions, answers, product mappings, and configuration). By using the App, you grant us a limited, non-exclusive license to access, process, store, and serve your quiz content solely as described in these Terms and our Privacy Policy, and for no other purpose.

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF PRODUCT RECOMMENDATIONS GENERATED BY THE APP.
• WARRANTIES THAT THE APP WILL IMPROVE YOUR STORE’S SALES, CONVERSION RATES, REVENUE, OR SHOPPER ENGAGEMENT.
• WARRANTIES THAT QUIZ ANALYTICS DATA IS COMPLETE, REAL-TIME, OR FREE FROM GAPS DUE TO NETWORK FAILURES, BROWSER BLOCKERS, OR SHOPIFY APP PROXY INTERRUPTIONS.

The recommendation logic is computed from the product-to-answer mappings you configure. The accuracy and relevance of recommendations is entirely dependent on the quality of your configuration.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIVE U.S. DOLLARS ($5.00).

The limitations set out in this section form an essential basis of the bargain between you and us, and we would not provide the App to you without these limitations.

13. Indemnification

You agree to defend, indemnify, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

• Your violation of these Terms.
• The quiz content you create and publish through the App, including any claims by shoppers or third parties regarding that content.
• Your use of the App in a manner not authorized by these Terms or our Privacy Policy.
• Your violation of any third-party right, including any intellectual property or privacy right.
• Any claim that your use of the App caused damage to a third party.

14. Third-Party Services

The App operates on the Shopify platform and relies on the Shopify Admin API, Shopify App Proxy, Shopify Billing API, and Shopify’s OAuth authentication system. Your relationship with Shopify is governed by Shopify’s own terms, not by these Terms. We are not responsible for any changes to the Shopify API, App Proxy, or platform policies that affect the App’s functionality.

If Shopify modifies or discontinues an API feature that the App relies on, we will make reasonable efforts to update the App. We make no guarantee of continued operation in the event of material changes to the Shopify platform.

Our application infrastructure is hosted on Railway. These are our sub-processors; we do not expose your data to additional third parties beyond those described in our Privacy Policy.

15. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the “last updated” date at the top of this page. For material changes, we will notify you via the App interface or by email to your store’s contact address at least 14 days before the change takes effect (or as soon as reasonably practicable where required by law or Shopify policy). Your continued use of the App after the effective date of revised Terms constitutes acceptance of those Terms.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict-of-law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

Any dispute arising out of or relating to these Terms or the App that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of San Francisco County, California, United States of America. You consent to personal jurisdiction in those courts.

Notwithstanding the above, we reserve the right to seek injunctive or other equitable relief in any jurisdiction to protect our intellectual property rights.

17. Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App, and supersede all prior agreements or understandings of any kind.

Severability. If any provision of these Terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any right or provision will be effective only if in writing and signed by our authorized representative.

Assignment. You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets, provided the assignee agrees to be bound by these Terms.

Force Majeure. We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure, Shopify platform outages, third-party infrastructure failures, or changes to Shopify’s API or App Proxy.

No Agency. Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and us.

Notices. Any notices or communications under these Terms will be sent by email to the address you have on file with Shopify (your store contact email) and, from you to us, to the support address below.
